By accessing and using this Site, you shall be deemed to have accepted to be legally bound by these Terms & Conditions as a user of the Site.

General

  • These Terms & Conditions may be changed from time to time. Changes will be posted on this page and your use of this Site after such changes have been posted will constitute your acceptance to the modified Terms & Conditions and all of the changes.

  • We reserve the right to refuse to provide you access to the Site or Services (defined below), or to allow you to open an account, or to block access from a particular Internet address to this Site, at any time, without ascribing any reason whatsoever. By using our Services or creating an account, you give your irrevocable acceptance of and consent to the terms of this agreement. If you do not agree to these terms, please do not use our Services or access the Site. If you are under the age of 18 or the legal age for giving consent hereunder pursuant to the applicable laws (the “Legal Age”), you must get permission from a parent or legal guardian to create an account and that parent or legal guardian must agree to the terms of this agreement.   • This Site is maintained by National Council of Social Service (NCSS).

  •  All rights, title and interest in the Contents (defined below) are owned by, licensed to, or controlled by NCSS. All intellectual property rights in and to the Contents on the Site and any materials published in it is owned by or lawfully licensed to NCSS and we reserve and retain all rights in such material. You acknowledge and agree that subject to these Terms & Conditions, you shall not, without our prior written consent, copy, reproduce, modify, republish, upload, post, transmit, adapt, download, distribute or howsoever deal with any Content or materials from the Site in any form. The name of Sharity may not be used in any way, including in any advertising or publicity, or as a hyperlink, without our prior written consent.

  • The “Services” we provide or make available include (a) the Site, (b) the Services provided by the Site and through the Site, and (c) all information, linked pages, features, data, text, images, photographs, graphics, music, sounds, video, messages, tags, programming, software, application services, documents, or other materials or content made available through the Site or its related services (“Content”). Any new features added to or augmenting the Services are also subject to these Terms & Conditions. These Terms & Conditions govern your use of Services provided by us.

Limited Licence

  • We grant you a limited and revocable licence to access the Site and our Services only for the purpose of facilitating your purchase of our product(s), and/or your engagement of the Services made available via this Site, and/or your preparations for each of the aforesaid, in accordance with these Terms and Conditions. All proprietary Content, trade marks (registered or unregistered), brand names, logos and other intellectual property displayed in the Site are the property of NCSS and where applicable, third-party proprietors identified in the Site. No right or licence is granted directly or indirectly to any party accessing the Site to use or reproduce any intellectual property, and no party accessing the Site shall claim any right, title or interest therein. By using or accessing the Services you agree to comply with the copyright, trade mark, and all other applicable laws that protect the Services, the Site and its Content. You agree not to copy, distribute, republish, transmit, publicly display, publicly perform, modify, adapt, rent, sell, or create derivative works of any portion of the Services, the Site or its Content. You also may not, without our prior written consent, mirror or frame any part or whole of the contents of this Site on any other server or as part of any other website. In addition, you agree that you will not use any robot, spider or any other automatic device or manual process to monitor or copy our Content, without our prior written consent (such consent is deemed given for standard search engine technology employed by Internet search websites to direct Internet users to this website).

  • The Contents on this Site are protected by the applicable intellectual property rights and may not be reproduced or appropriated in any manner without written permission of the rights owner. Except as otherwise provided, the Contents of this Site owned by NCSS shall not be reproduced, republished, uploaded, posted, transmitted or otherwise distributed in any way, without the prior written permission of NCSS.

  • Unauthorised modification of any of the Contents or unauthorised use of the Contents for any purpose not permitted by NCSS may be a violation of NCSS' intellectual property rights.

Disclaimer of Warranties and Liability

  • The Contents of this Site are provided on an "as is" and "as available" basis without warranties or representations of any kind, express or implied, statutory or otherwise. To the fullest extent permitted by law, NCSS does not warrant, and does hereby disclaims any warranty:

a)     As to the accuracy, correctness, reliability, timeliness, non-infringement, title, merchantability or fitness for any particular purpose of the material of this Site; and

b)     That the Contents available through this Site will be secure, or any functions associated therewith will be uninterrupted or error-free, or that defects will be corrected or that this Site and the server is and will be free of all viruses and/or other harmful elements.

  • We assume no responsibility for errors or omissions in the materials on the Site, including factual or other inaccuracies or typographical errors. You expressly agree that your use and/or access of the Site is at your sole risk.

  • Without prejudice to the generality of the foregoing, we expressly disclaim any and all liability arising from:

a)     Life or wear of any product or that it will be suitable for any particular purpose or use under any specific conditions, notwithstanding that such purpose or conditions may be known or make known to us;

Your payment for any product(s) purchased from the Site is processed by third-party payment system providers and we do not retain or process any such payment information other than for the purposes of providing you with the products or services specified in the Site in accordance with applicable law. We do not guarantee the security of such third-party payment system(s) or any payment data on the Site, you agree that we are not responsible for any acts or omissions of any third parties and disclaim any and all liability in connection with the acts, omissions or defaults of such third parties. To the extent that any exclusion of liability under the Terms & Conditions is not permitted under law, our aggregate cumulative liability under any claim shall in any event not exceed the sum that you have paid to us for the purchase of our products under your order.

NCSS is not responsible for the contents of those websites and shall not be liable for any damages or loss arising from access to those websites. This is deemed to be the case even after the posting of any changes or modifications to these Terms & Conditions.   • In no circumstances shall NCSS be considered to be associated or affiliated in whatever manner with any trade or service marks, logos, insignia or other devices used or appearing on websites that link to this Site or any of the Contents.

  • NCSS reserves all rights to disable any links to, or frames of any site containing inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topics, names, material or information, or material or information that violates any written law, any applicable intellectual property, proprietary, privacy or publicity rights.

  • NCSS reserves the right to disable any unauthorised links or frames and disclaims any responsibility for the content available on any other site reached by links to or from this Site or any of the Contents.

Terms of Use

  • The licence for access of this Site and our Services is effective until terminated. This licence will terminate as set forth under these Terms & Conditions or if you fail to comply with any term or condition of these Terms & Conditions. In any such event, we may effect such termination with or without notice to you.

  • You agree that you will NOT, in connection with this Site, the Contents, and the Services, whether by yourself or with the assistance of another:

    • Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of NCSS or our vendors;

    • Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information of NCSS or our vendors;

    • Advertise or offer to sell or buy any goods or services for any business purpose, unless prior written approval has been provided by us;

    • Conduct or forward surveys, contests, pyramid schemes, or chain letters;

    • Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of our Services (including products made available through the Services) or Contents;

    • Harvest, or otherwise collect, use, and/or disclose any information and/or personal data which you are not authorised to collect, use, and/or disclose; 

    • Inject, introduce, upload, transmit, or distribute (and/or attempt to do any of the aforesaid) any virus, worm, Trojan horse, spyware, malware, ransomware, or any other computer code, file, or program that is malicious, technologically harmful, or designed to interrupt, destroy, damage, or limit the functionality of any computer software, hardware, network, or telecommunications equipment (this includes without limitation content or computer code relating to HTML, JavaScript, or SQL);

  • NCSS reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in NCSS's sole discretion.

Orders and Services

  • You may place an order with us by completing and submitting the order form on the Site. It is your responsibility to ensure that your order and all information provided to us is accurate. An order shall be deemed irrevocable and unconditional upon transmission through the Site, and we shall be entitled, but not obliged, to process such any such order without your consent and without any further reference to you.

  • We reserve the right to accept or decline any and all orders received from or through the Site in our sole and absolute discretion without assigning any reason, and we will notify you if we are unable to accept and/or process your order for any reason including, without limitation, if the product(s) in your order is out of stock or is unavailable, if there are limitations on our resources for which we could not reasonably plan, if we have identified an error in the price and/or description of the product, or if we are unable to meet a delivery deadline or other request you have specified. Orders placed through the Site are for personal and/or gifting purposes only and not for commercial purposes (such as resale), and without prejudice to the generality of the foregoing, we reserve the right to restrict orders for multiple quantities of any item(s) to any one customer or address.

  • The price payable by you for a product shall be the price listed for sale as stated on the Site at the time your order is transmitted to us through the Site, together with any applicable taxes. For the avoidance of doubt, you shall be responsible for the payment of any and all taxes or duties levied or charged on your order. We reserve the right to amend the price of any product at any time without giving any reason or prior notice. Unless otherwise stated, prices are in Singapore dollars and prices specified in any other currency are for your reference only and the actual amount you pay for a product in any currency other than Singapore dollars will be determined by the relevant third-party that processes the payment of your order. Any orders that are unpaid after the specified payment timeframe shall be deemed cancelled unless we determine otherwise in our discretion. In the event that any product has been mispriced on the Site, we reserve the right to terminate the order and notify you of such termination, regardless of whether or not the products have been dispatched or are in transit and whether payment has been charged to you.

Product Information and Descriptions

  • We endeavour to be as accurate as reasonably possible in the information we provide about the products available for purchase through the Site, including in relation to product descriptions, pricing, promotions, availability and shipping information. We however do not warrant or represent that such information provided on the Site is accurate, complete, reliable, current, or error-free. We reserve the right to correct any inaccuracies, omissions or errors, and to update or amend the information, or to cancel any orders in the event that any information is, in our reasonable opinion, materially inaccurate or erroneous.

  • Our products may differ from the images of our products on the Site and the colours of the products may differ in reality due to studio lighting conditions, or variances in computer screen calibration. We ensure that screen colours are true to life as much as possible. Regardless, the images of the products on our Site are for illustrative purposes only. Minor variations in measurements (within 1 inch or 2.5cm are not considered a defect.

Delivery

  • For more information on shipping and delivery of your order, please refer to our FAQ page. Any delivery times and dates specified on the Site are only estimates and the time taken for delivery may be longer. Deliveries are outsourced by us to external third-party delivery providers and we shall not be liable for any delay in or complications relating to the delivery of your order.

  • Should the item(s) that you order be out of stock or on back-order, the delivery of your entire order will only take place once such item(s) become available, unless otherwise specified by you at the time of your order.

  • If the delivery of your order fails for any reason and your order is returned to us, we would be happy to arrange for the re-delivery of your order, subject to you paying us for any costs incurred by us in relation to the return of your order and/or for such re-delivery. We reserve the right to terminate your order should you repeatedly fail to take delivery.

Incorrect or Incomplete Orders and Defects

  • If you believe that you have received the wrong item(s), that your order is incomplete, and/or that any item(s) you received is defective, please contact us at, Team_Sharity@ncss.gov.sg with your order number so that we may assist you. Please note that any notice of an incorrect or incomplete order or defective item(s) should be notified to us within 7 days of the delivery of your order. We may ask you to provide us with reasonable assistance and information as we may require, including providing photographs of item(s). In the event that we ask you to send any item(s) back to us, we will reimburse you for the cost of sending such item(s) to us at the delivery mode specified by us. Please note that items sent back to us should be unused, unwashed, unopened, in the original packaging. If the correct item is no longer available, we reserve the right to issue a refund to you instead.

Termination

  • Without prejudice to any part of the above, we may terminate an order at any time by written notice to you if:

    • You do not make payment to us when it is due;

    • You do not, within reasonable time, provide us with information necessary for us to provide you with any product(s) or service(s) such as your delivery address; or

    • You breach or do not comply with any of these Terms & Conditions.

  • If we terminate your order, we will refund any amounts you have paid in advance for any product(s) or service(s) we have not provided, subject to the deduction of any costs and/or expenses incurred by us prior to the termination of such order

  • Moreover, you acknowledge and agree that we may terminate our contract with you at any time by providing you with a written notice. 

Governing Law

  • These Terms & Conditions shall be governed and construed in accordance with the laws of the Republic of Singapore.
